By downloading, installing, accessing, or using Textulater, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

Textulater is a privacy-focused iMessage extension designed to help users reduce unnecessary exposure within everyday messaging workflows.

The platform provides communication features intended to support more controlled sharing of sensitive information within the Apple iMessage environment, including:

• dual-layer messaging functionality
• private content embedded beneath a standard message
• biometric access controls
• message visibility and expiration controls
• related privacy-focused communication features

Textulater is not intended to replace:

• legal practice management systems
• secure document management platforms
• regulatory compliance systems
• emergency communication services

You must be at least 18 years old to use Textulater.

By using the Service, you represent and warrant that:

• you are at least 18 years old
• you have the legal authority to agree to these Terms
• your use of the Service complies with all applicable laws, regulations, and professional obligations

You agree to use the Service responsibly and lawfully.

You may not use Textulater to:

• violate applicable laws or regulations
• harass, threaten, or harm others
• distribute illegal or abusive content
• engage in fraud or deceptive activity
• impersonate another person or entity
• distribute malware or malicious software
• interfere with platform security or operations
• evade legal preservation, disclosure, or retention obligations

Users remain solely responsible for:

• the content they send
• their communication practices
• compliance with legal, ethical, professional, and organizational obligations

Privacy-focused features, including message expiration or deletion functionality, must not be used for unlawful purposes or to obstruct lawful investigations or legal obligations.

Textulater provides a platform for communication between users.

We do not actively monitor, review, or endorse the content of private user communications.

Users are solely responsible for the content they transmit through the platform and for determining whether use of the Service is appropriate for their specific professional, legal, or organizational environment.

Textulater is designed to help reduce unnecessary exposure within messaging workflows. However, no communication platform can guarantee complete confidentiality, privacy, or security.

Textulater does not guarantee:

• legal compliance
• regulatory compliance
• attorney-client privilege protection
• HIPAA, GDPR, or ABA compliance
• prevention of screenshots, recordings, or third-party capture methods
• prevention of unauthorized access or disclosure

Use of the Service should be considered alongside:

• device security practices
• organizational policies
• professional responsibilities
• applicable legal obligations

Your use of the Service is also governed by the Textulater Privacy Policy.

All software, technology, branding, designs, trademarks, and related content associated with Textulater are owned by Textulater LLC or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted, users may not:

• modify
• reproduce
• distribute
• reverse engineer
• resell
• create derivative works from

any portion of the Service without prior written permission.

If you download or use Textulater through the Apple App Store, you acknowledge and agree that:

• Apple is not responsible for the Service
• Apple has no obligation to provide maintenance or support for the application
• Apple is not responsible for addressing claims related to the application

These Terms are between you and Textulater LLC, not Apple Inc.

We strive to maintain reliable platform availability and functionality. However, Textulater does not guarantee that the Service will always be:

• uninterrupted
• secure
• error-free
• available at all times

We reserve the right to modify, suspend, limit, or discontinue any portion of the Service at any time without prior notice.

To the fullest extent permitted by law, Textulater LLC and its affiliates, owners, employees, contractors, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from:

• use of the Service
• inability to use the Service
• unauthorized access to communications
• loss of data
• exposure of sensitive information
• third-party actions
• interruptions or security incidents

Users assume full responsibility for their use of the platform and communication practices.

You agree to indemnify, defend, and hold harmless Textulater LLC and its affiliates, owners, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, expenses, or legal fees arising from:

• your use of the Service
• your communications or content
• your violation of these Terms
• your violation of applicable laws or professional obligations

We reserve the right to suspend, restrict, or terminate access to the Service at any time if:

• these Terms are violated
• unlawful or abusive activity is suspected
• platform security or integrity may be compromised
• continued access may expose Textulater or its users to risk

Termination may occur without prior notice where reasonably necessary.

We may update these Terms from time to time.

When updates occur, the revised version will be posted with an updated “Last Updated” date.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the United States and the laws of the State of Missouri, without regard to conflict of law principles.
